Separation Agreements

A Separation Agreement is an Agreement entered into by spouses where a Marriage has broken down and where they wish to avoid going to Court. This Agreement is reached by way of negotiation between spouses either through separate legal representation or by Mediation. The main provisions in a Separation Agreement can include:  

  • An agreement to live apart.
  • Arrangements in relation to custody and access to the children.
  • Occupation and ownership of the family home and any other property.
  • Maintenance and any lump sum payments.
  • Indemnity from the debts of the other spouse.
